1724 On 11 July: A Message from the Assembly by Mr Philipse, Coll Provoost, Coll Willett and Coll Hicks dated the ninth instant with the Bill Entitled, An Act for raising and Levying the Sum of Six Thousand Six hundred and thirty pounds for the Supplying the Deficiencys of his Majestys Revenue and for the Several Uses and Purposes therein mentioned and for making Bills of Credit to be Issued for that Value. {page 511}

1724 On 21 July: Ordered, that the Bill Entitled, An Act to prevent Boats and other vessels and the Goods put on Board of them from being interrupted or molested whilst their navigation is Confined within this Colony, be Referred to the Gentlemen of this Board or any five of them find that the Collector and Receiver Generals Petition Relating thereto be considered by the same Committee as Likewise the Depositions of James Small shanks and Thomas Scudder laid before this Board by Coll Hicks, Coll Thomas Willet and Cap1 Van Home by order of the General Assembly. It [is] further Ordered, that the Said Committee do at the Same time Consider of the Laws of Trade So far as it relates to the Said Bill. {page 514}

1726 On 18 May: A Message from the Assembly by Cap Hicks with the Bill Entitled, An Act for reviving and continuing An Act to prevent Small Stallions running at large and to geld all horses under the size therein mentioned and desiring the concurrence of this Board thereto. {page 527}

1726 On 7 June: A Message from the Assembly by Coll Hicks with the Bill Entitled, An Act for Discharging a Debt to the late Agents for this Colony at the Court of Great, Britain for finishing and completing the buildings in his Majestys Fort George for borrowing certain sums for those purposes out of the ffonds therein mentioned and for Laying a Tax to make good such parts thereof as stand appropriated to particular uses. {page 530}

1726 On 7 June: This is a civil matter: The Petition of Thomas Hicks seting forth that Major Daniel Whitehead Deceased did by his Will Devise unto Grandson Whitehead Hicks since Deceased Diverse Tracts of Land within the Township of fflushing in the parish of Jamaica in Queens County but under the Limitation of a General Intail and that the petitioner is Eldest brother and heir of the said Whitehead Hicks to whom the said Tracts of Land Descend in Tail by virtue of the said Devise and that he had in pursuance of an Instruction from the Regency in his Majestys name to his Excellency dated at Whitehall the 23d of July 1723 given due notice of his Intention to apply for such An Act

These are to give notice to whom it may concern that whereas Major Daniel Whitehead Deceased Did by his Last Will and Testament devise and bequeath unto his Grandson Whitehead Hicks since deceased Diverse Tracts of Land within the Township of Flushing in the parish of Jamaica Being Eleven Lotts of Ten acres each and some other small Parcells but under the Limitation of a General Intail, I the underwritten Thomas Hicks Eldest brother and heir of the said Whitehead Hicks to whom the same Lands are Devolved do design to apply to the Honorable the General Assembly of this Colony of New York for the passing of An Act to Cut of the said Intail and that the said Lands may be vested in me in See simple T HICKS Junr. 1727 On 11 November: A Message from the Assembly by Collonell Hicks with the Bill Entitled, An Act for preventing prosecutions by Information. {page 559}

1727 On 18 November: A Message from the Assembly by Collonell Hicks with the Bill Entitled, An Act for naturalizing James Fauviere and Charlotte his wife, Hester Bisley the wife of Thavet Besley, John Sybrandt, Susannah Mercier Widow, Daniel Nunes De Costa, John George Puschart and Jacob Bomper Acquainting this Board that that house had agreed to the additional Clause made to the Said Bill by this Board Ordered, that the Said Bill do pass {page 561}

1727 On 24 November: A Message from the Assembly by Collonell Hicks and Mr Livingston with the Bill Entitled, An Act for defraying the Cost and Contingent Charges of the Trading house Erected at Oswego and the maintaining [it] during the time therein mentioned for applying Several Funds and Certain Sum out of the Excise for that purpose for the effectual Recovery of former fines and Forfeitures for continuing the different dutys on Indian Goods during the time therein mentioned and for making good the money So to be borrowed of the Excise and desiring the Concurrence of this Board thereto {page 561}

1727 25th November: Die Sabbat: Coll Hicks from the Committee of Grievances reported that as well by the Complaints of several people as by the General Cry of his Majestys Subjects Inhabiting this Colony they find that the Court of Chancery as Lately assumed to be Sett up Here renders the Libertys and properties of the said Subjects extremely Precarious and that by the violent measures taken in & allowed by it some have been ruined others obliged to abandon the Colony and many restrained in it either by Imprisonment or by Excessive bail Exacted from them not to depart even when no manner of suits depending ag them and therefore are of opinion that the Extraordinary proceedings of that Court and the Exorbitant fees and charges Countenanced to be Exacted by by the Officers and Commissioners thereof are the greatest grievance and oppression this Colony has ever felt and that for removing the fatal consequences thereof they had come to several resolutions which being read were approved of by the House and are as follows Resolved, that the Erecting or Exercising in this Colony a Court of Equity or Chancery (however it maybe Termed) without Consent in General Assembly is unwarrantable and Contrary to the Laws of England and a Manifest oppression and grievance to the subjects and of pernicious Consequence to their Libertys and propertys. Resolved, that this House will at their next meeting prepare and pass An Act to declare and adjudge all orders ordinances Devisees* and proceedings of the Court so assumed to be Erected and Exercised as above mentioned to be illegal Null and void as by Law and of right they ought to be Resolved, that this House will at the same time take into consideration whether it be necessary to Establish a Court of Equity or Chancery in this Colony in whom the Jurisdiction thereof ought to be vested and how far the powers of it shall be prescribed and Limited. {page 562-63}

1729 On 19 June: Upon reading an order of the House of Representatives appointing Coll Hicks, Mr Gilbert Livingston, Coll Hutchinson, Coll Phill. Schuyler, Mr Gerritsen, Major Renslaar and Coll Beekman or any five of them to be a Committee of that House to meet a Committee of this Board to confer upon the subject matter of the Bill Entitled, An Act for the more Easy acknowledgement of Deeds together with the Message of that House of the 22d May last relating to the amendments of this Board thereto. {page 584}

Ordered, that Adolph Philipse Esqr James Alexander Esqr , John Walter Esqr , Simon Johnson Esqr David Jones Esqr and Coll Isaac Hicks be a Committee of the House to prepare An Address of Condolence to his Majesty on the ever to be lamented event of the Death of Her late Majesty Queen Caroline, and that His Honour the Lieutenant Governor and the Council be requested to join therein {page 718}
