Notes for Daniel Ivins and Theodosia Hammell

Daniel Ivins served in the War of the Revolution, and was judge of the court of Burlington county, New Jersey, for about thirty years. He died at age eighty-six years.

1777 Daniel Ivins, of Mansfield, Burlington County, New Jersey, and Theodosia Hammell were issued a marriage license in New Jersey. Dated July 25. Bond by Richard Shreve and Daniel Ivins. [1] [2] [3]

1792 Moses and Daniel Ivins, perhaps this one, inventoried the estate of Caleb Shreve of Mansfield Twp, Burlington County, New Jersey.

1810 Abner Page and Daniel Ivins made the inventory for the estate of John DeCou Sr of Mansfield Twp, Burlington County, New Jersey.

1842 The will of Daniel Ivins, Sr. (son of Solomon Ivins and Elizabeth Everingham and spouse of Theodosia Hammell) stated:

I Daniel Ivins senior of the Township of Hamilton in the county of Mercer and State of New Jersey being weak in body, but of sound mind, memory and understanding, do make, publish and declare this my last will and testament, in manner and form following that is to say

First, it is my will, and I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be, after my decease.

Second, I give and bequeath unto my son John Ivins seven hundred dollars, to be paid one year after my decease, provided he shall withdraw and discontinue the suit he has instituted against me, in the court of common pleas for the county of Burlington, and relinquish all claims of debt against me and my estate, but if he shall refuse or neglect to withdraw and discontinue the said suit, and relinquish said claims of debt for the space of one year after my decease, then the said legacy to be void, and the said seven hundred dollars to be reckoned as part of the residue and remainder hereinafter mentioned

Third, I give and bequeath unto the five sons of my son Theodore viz Daniel, Benjamin, Theodore, Barzillai and George Ivins, one hundred dollars each, to be paid to them in one year after my decease

Fourth, I give and bequeath unto my granddaughters Elizabeth Cubberly, my redish colored bedquilt and little trunk, unto Rebecca Vanness, my light block worked bedquilt, and unto my granddaughter, Theodosia Ivins, the daughter of my son Daniel, my bed, bedstead and sacking bottom

Fifth, I give and bequeath unto my son Daniel Ivins, and my daughter Deborah Forsyth, all the residue and remainder of my estate, to be divided between them, share and share alike

Sixth, I hereby appoint my son Daniel Ivins Executor of this my last will and testament. In Witness whereof I have hereunto set my hand and seal, this twenty third day of the twelth [sic] month, in the year of our Lord one-thousand eight hundred and forty two.

Signed, sealed, published and declared, by the said Daniel Ivins, to be his testament and last will, in the presence of us, the word "Senior" being first interlined. Thomas Blake, Peter Decou, Possible illegible signature Jacob West.

1843 Codicil:

I Daniel Ivins Senior of the Township of Hamilton in the county of Mercer and the State of New Jersey do this twenty third day of the fifth month Anno Domini eighteen hundred and forty three make and publish this codicil to my last will and testament in manner following, that is to say, Whereas I have in said will bearing date the twenty third day of the twelth [sic] month 1842 bequested a certain legacy to my son John Ivins now I do hereby expressly declare that my will is that the said legacy shall be chargeable with all damages, demands and liabilities which for my estate may sustain or be at any time called upon to pay to fore or on account of my said son John either during my life or after my decease whether such demands or liabilities shall grow or arise out of suits or demands brought by him against me or my estate or out of any obligation or contract whatsoever upon which I or my estate may now or hereafter be found to be in any way laiable and all costs and charges to which I or my estate may be at any time subjected in consequence thereof, and my executor is not to pay the said legacy or any part thereof until all said claims demands or liabilities are fully settled and discharged and then only such balance as shall remain of said legacy after deducting from the amounts thereof all such claims and liabilities as aforesaid which may have been established against or paid by me or my estate--Also having in said will bequested unto the five sons of my son Theodore deceased viz Daniel, Benjamin, Theodore, Barzillai and George Ivins one hundred dollars each, And Whereas I am bound with my son John Ivins in a certain bond given to the Surrogate general of the State of New Jersey conditioned for his faithful performance of the duties of administrator to the estate of my son Theodore Ivins deceased, it is my will and I hereby order and direct that if my estate shall have to pay to the estate of my said son Theodore Ivins deceased the amounts of the aforesaid bonds or any part thereof, the amount thus paid shall be charged to and deducted from the legacies of the aforesaid Daniel, Benjamin, Theodore, Barzillai and George Ivins sons of my son Theodore deceased in proportion to the legacy of each, provided nevertheless that the last mentioned legacies shall not be chargeable with any part of the aforesaid bonds that may be liquidated by the provision made in the first part of this codicil after all other claims and liabilities are discharged and settled as therein directed, And Lastly so much and such parts of my said will as is or are contrary to this codicil is hereby revoked and declared null and void. In Witness Whereof I have hereunto set my hand and seal the day and year first written. Signed, sealed, published and declared by the said Daniel Ivins, Senior as a codicil to his last will and testament in presence of us
