Notes for Thomas Stoughton and Jane Omer

c1542 Jane Omer, daughter of Lawrence Omer and his wife Ellen, was born. In Chancery Decree, C78/6/35, transcribed below, she is described as "an infante of the age of viijto yeres."

c 1550 Plaintiff "Jane, daughter of Laurence Omer," sued defendants "Richard Monynges, gentleman, and George his brother" concerning "Marsh lands (described) in Ash by Sandwich of the demise of the archbishop of Canterbury. Kent. See C78/6/35. 1544-1551" [1] Jane Omer v. Richard Monyngs and George Monyngs: two answers, two replications and two rejoinders. (Covering dates 1547 Jan 1 - 1600 Dec 31) [2] Richard Monynges was the overseer named in the will of Jane's father, Laurence Omer.

1550 On October 20 a dispute between Jane Omer and Richard and George Monyngs was settled in the Court of Chancery. [3] [4]

Where as mater in variaunce hathe dependid in this honerable Courte of Chauncery betwene Jane Omer an infante of the age of viijto yeres doughter of Laurence Omer decessid Complaynante and Richarde Monyngs Gentilman and George Monyngs his brother defend' of for and concerning the title possession and intereste of a lease made by Thomas Diggs Esquier to Laurence Omer of Asshe deceassid for the time of xix yeres of and in a parcell of mershe grounde called the hunderithe acres conteyning by estymacion a hunderthe acres one parcell of mershe grounde callid the Siwis mershe conteyning by estymacion lxx acres one parcell of mershe grounde callid the newe leys conteyning by estimacion lxx acres one parcell of mershe grounde called milborough mershe conteyning by estymacion xlti acres one parcell of mershe grounde called Bullocke leys conteyning by estymacion xxxti acres and Cth acres of erable land and pasture callid Warchawthorne with theappurtynaunces set lying and being in the parisshe of Asshe nyghe Sandwiche whiche variaunce commensid betwene the said Jane and the said Richarde and George uppon title whiche the same Jane pretendid to have to the premisses by the laste will of the said Laurence Omer hir father and to whiche premisses the said George and Richarde made title vnto by reason of a gifte and graunte frome Ellyn Omer executrix of the said Laurence Omer and mother to the said Jane and by a lease made to the saide George frome the said Thomas Diggs for thappertenances wherof and for a fynall ende and determynacion to be had therin this present time of Seynte Michaell that is to saye the xxth daye of Octobr in the fourthe yere of the reigne of our soueraigne lorde kyng Edwarde the vjte by the grace of god kyng of England France and Ireland defendour of the faithe and of the Churche of England and also of Ireland in earthe the supreme hed yt is orderid adiuged and fynally decreed by the right honerable Sir Richarde Ryche Knyght lorde Ryche and lorde Chauncellor of Ingland and By the said Courte of Chauncery and also by the assents and consents of the said George Monyngs one of the said defendaunts forsomoche the said Richarde thother of the said defendaunts hath disclaymed to have any right or title to the premisses being presente in the said Courte of Chauncery in his owne parson and Edwarde Stoughton Gentilman being father in lawe and garden to the said Jane Omer being also present in the said Courte of Chauncery that the said George Monyngs his executours and assignes shall quietly and peacible have holde occupie and enjoie without lett distirbaunce or interruption of the said Edwarde Stoughton and Ellyn his wife and Jane Omer or any of them there executours or assignes and without interruption of any other persone or persons pretending title mediatly or ymediatly frome and by the said Edwarde Ellyn and Jane or any of them the said hunderth acres the slewis mershe newe lease Milborough mershe Bullocke lease and the vplands being the lands of the lorde Archebusshop of Caunterbury callid Warchowthorn with theappertynance during and by all suche intereste and terme of yeres whiche Laurence Omer late husband of the said Ellyn had of the demyse and leasse of the said Thomas Diggs Esquier decessid and it is further orderid and decreed by thauctorite and consents aforesaid that the said George Monyngs and William lane the younger Citizen and grocer of london brother in lawe to the said Goerge Monyngs there heires execut' or assignes shall paye or cause to be paied to the said Edwarde Stoughton his executours or assignes to the use of the said Jane xv li of good and lawfull money of Englande in manner and forme following that is to saye v li therof at or outhisside the feaste of all Saynts nexte ensuying and other v li therof at or on thisside the feaste of Easter then nexte ensuying and other v li residue of the said xv li at or on thisside the feaste of the Natiuite of Saynte John baptiste then nexte ensuying in full contentacion and satisfacion of the said xv li and moreouer it is ordered and decreed by thauctorite and consents aforesaid that the said Edwarde immediatly after the signyng of this decree shall stande and be bounden to the said George his heires executours or assignes in the some of on hunderithe pounds of good and lawfull money of Englande by his obligation with condicion that the said George his executours or assignes shall quietly and peacible have holde occupie and enyoie the said Cth acres and other the premisses in maner and forme afore mensionyd without lett or intervpcion of the said Edwarde Ellyn or Jane or any other for them or by there assents or procuerments and likewise it is ordered and decreed by thauctorite and consents aforesaid that the said George Monyngs and the said William lane immediatly after the signyng of this decre then shall stande and be bounden to the said Edwarde his heires executours or assignes in the somme of xxx li of good and lawfull money of Englande by there obligacion with condicion for the trewe payment of the said xv li in manner and forme also above mencionyd and at the days and feastes above lymitted assigned and specified.

1556-1558 Thomas Stoughton and Jane Omer were married by 1556-1558 as plaintiffs "Thomas Stoughton of Ash and Jane his wife" sued defendant "Juliana Pynnor(?) and John her son" in the Court of Chancery concerning a "messuage and land called Little Betshanger, late of Laurence Omer, deceased. Kent." [5]

1559 Daughter Ellen Stoughton was baptized in October in St. Nicholas, Ash, Sandwich ("October ... Ellen Stockton" -- the date is not readable, but this was the 2nd of 3 baptism in October). [6]

1563 Mary, daughter of Thomas Stoughton, was baptized on November 25 in St. Nicholas, Ash, Kent ("November ... Mary d. of Thomas Stoughton baptized xxvth"). [7]

1565 Jane, the wife of Thomas Stoughton, was buried on April 22 in St. Nicholas, Ash, Kent ("Aprill ... Jane w: of Thomas Stoughton buryed xxijth"). [8]

1573 Thomas Stoughton and Agnes Freeman, widow, were married on July 5 in St. Nicholas, Ash, Kent ("Julye ... Thomas Stoughton g': & Annys Freeman wyd m: vth") [9]

1591 The will of Thomas Stoughton names (among others) the sons Thomas Omer and Roger Omer and daughter Izanna Newnam of his sister Omer. [10]

1591 Thomas Stoughton died on June 12 and was buried at St. Martin, Canterbury, Kent, England. [11]

In the chancel, on a flat stone, brass, a full length man, on a plate in modern letters, 'Here lieth Thomas Stoughton, of Ash, in the county of Kent, who departed this lyfe the xiih of June, 1591.'
