Notes for Eudo la Zouche and Millicent de Cantelupe

1253 On July 2, Eudo la Zuche purchased the marriage of Agatha de Ferrers, daughter of William de Ferrers. [1]

37/1075 (02 July 1253) [No date]. Concerning a fine for Eudo la Zuche. Eudo la Zuche gives the king 150 m. for the marriage of Agatha daughter of William de Ferrers earl of Derby if the same earl shall wish to approve assent to that marriage, of which the same Eudo will render 25 m. at Michaelmas in the thirty-seventh year and 25 m. at Easter next following, and thus 50 m. from year to year at the same terms until all the aforesaid debt shall have been paid to the king. And if the same Eudo has neither the aforesaid marriage nor the profit of the same marriage, the king wills that he be forever quit of the aforesaid £100.

1263 Eudo la Zouche and Millicent de Cantelo were married before Trinity term when they were plaintiffs in the following case: [2] [3]

Leicester. Eudo la Zuche and Milisent his wife v. Anketill de Martivaus. steward of S. de Montfort, earl of Leicester, Walter de Wiltes and Peter de Baggewurth in a plea wherefore, since Eudo and Milisent lately, in the king's court at Canterbury, recovered against the said earl free power of giving and taking estover in a certain wood of Eudo and Milisent in Lubbestorp by an assize of novel disseisin before the justices at Leycester between the said Eudo and Milisent and the said earl there taken and by consideration of the said court, the said Anketil and the others impede Eudo and Milisent in carrying out this verdict. Anketil is attached by John le Franceys of Nouseley and Richard son of Reginald of the same.

1269 In Easter term, William Hamelyn and others answered Eudes la Zouche regarding a trespass in Clipsham, Rutland. [4]

1273 Eudes la Zouche, Henry la Zouche, and John Coe served as manucaptors (or sureties) for Joyce, daughter and heiress of William la Zouche to appear in Westminster a day in St John Baptist. [5]

1273/74 Millicent's share of the inheritance of her brother George Cantelo was delivered to Eudo la Zusche and his wife Millicent. [6]

March 1. St. Martin le Grand, London. Order to the same [escheator on this side Trent] to deliver to Eudo la Zusche, who has taken to wife Millicent, sister and one of the heirs of George de Cantilupo, deceased, tenant in chief, and to Millicent, the pourparty of the inheritance of the said George falling to Millicent, to wit, the manors of Eyton and Hoghton, co. Bedford, Haringworth, Bereweby and Bulewyk, co. Northampton, Brugewater, Heygrave and Edenewrth, co. Somerset, Calston, Brihtmerston, Rocle and Calne, co. Wilts, Cornewrthy, Dertemue and Totteneys, co. Devon, Moles Bracy, co. Salop, Stokes St. Edwald, co. Dorset, and 13s. 4d. in Hereford, co. Hereford, Bingele, co. York, and Baseford, co. Nottingham.
Bergeveny with the castle, honour and other appurtenances, Kilgaran with the castle and other appurtenances, a third part of the land of St. Clear, Aston, co. Warwick, Berewik, Little Merston and Stotford, co. Somerset [and] Bademondefeud, co. Suffolk, remain in the king's hand by reason of John de Hastinges, son and heir of Joan de
Hastingis, eldest sister of George de Cantilupo, until the full age of the heir of Joan. The manor of Rowell, extended at 17l., and Hamme, co. Buckingham, extended at 4l. 19s. 2d., which are of the sum of the pourparty of John de Hastinges, are assigned to Eudo la Zuch and Millicent his wife, the other heir of the said George, to hold in tenancy at the king's will for their claim to the extent of Bergeveny.
Order to the same to deliver to the said Eudo and Millicent the manors of Rowell and Hamme to hold as above [last entry].
Order to the escheator beyond Trent to deliver to the same Eudo
and Millicent the manors of Byngele and Baseford, late of the said
George de Cantilupo, to hold as her pourparty.

Complete Peerage states, [7]

He [Eudo la Zouche] married, before 13 Dec. 1273, Milicent, widow of John de Mohaut, sister and co-heiress of George de Cauntelo, lord of Abergavenny, &c. (d.s.p. 18 Oct. 1273), da. of William de Cauntelo, of Calne, Wilts, Aston Cantlow, co. Warwick, by Eve, 3rd da. and co-heiress of William de Briouze, lord of Abergavenny aforesaid.

Douglas Richardson states, [8]

… Complete Peerage indicates that Sir Eudes la Zouche and his wife, Milicent de Cantelowe, were married before 13 December 1273 [Reference: Cal. Inq. p.m., vol. ii, no. 17 (pp. 19-20)]. However, given that Milicent de Cantelowe's first husband, John de Mohaut (on Montalt), died in 1258, I've always assumed that Sir Eudes and his wife Milicent were married some time before 1273, possibly as early as 1260.

Recently I located a lawsuit dated Easter term 1269 [53 Henry III], in which Eudes la Zouche sued William Hamelyn and others regarding a trespass [vi et armis] in Clipsham, Rutland. Reference: Justice Itinerants, JUST1, no. 1201, Image 1744f, Year: 1269 ...

My research indicates that the manor and advowson of the church of Clipsham, Rutland were earlier acquired in 1243 by Milicent de Cantelowe's grandfather, Sir William de Cantelowe, from Peter de Fraxineto [Freney] [Reference: VCH Rutland 2 (1935): 41-45; Cal. of Charter Rolls, 1 (1903): 276]. In 1245 Sir William de Cantelowe was granted free warren in the demesne lands and woods in his manor of Clipsham, Rutland [Reference: Cal. of Charter Rolls, 1 (1903): 284].

Given that Clipsham was earlier a Cantelowe family property, it seems likely that it formed part of the maritagium of Milicent de Cantelowe and was brought by her in marriage to Sir Eudes la Zouche. As such, it seems certain that Sir Eudes and Milicent were married sometime before Easter term 1269, the date of the lawsuit.
