Notes for John Tomlin and Mary Underdown

1620 John Tomlyn and Mary Underdowne received a marriage license and were married on November 2 at St Mary Breadman in Canterbury, Kent, England.

Tomlyn, John, of S. Lawrence in Thanet, yeom., ba., about 20, under the govt. of John Sackett, who consents, as is testified by Vincent Underdowne, s. p., yeom., and Mary Underdowne, s. p., maiden, about 22, d. of Vincent Underdowne abovesaid, who is present and consents. At S. M. Bredman's, Cant. Nov. 2, 1620. [1]

The marriage was recorded in the St Mary Breadman in Canterbury register as "The second day of November were married John Tomlin of the parish of St Lawrence in ye Ile of Thanett yeoman, and Mary Underdowne of ye same parish maide by Licence." [2]

The marriage was also recorded in the St Lawrence, Thanet, register, as "John Tomlin & Mary Underdowne mar. by licence in Cant. ye second of November." [3]

1649 John Tomlyn wrote his will on June 22. [4]

In the name of God Amen this two and twentieth day of June in the yeare of our Lord god one thousand six hundren forty and nyne I John Tomlyn of the parish of St John Baptist in the Isle of Thanent and County of Kent yeoman being sicke and weake in body, but of good and perfect minde and memory (praised be god) doe make and ordaine this my last will and testament in manner and forme following First and principally I commend my soule into the hande of Almighty god my Maker who gave it mee trusting by and through the merritts and precious death and passion of his only sonne and my alone Saviour and Redeemer Jesus Christ to have free pardon and remission of all my sinns, And my body I committ to the earth from whence it was taken. There to rest in stedfast hope of a ioufull resurrection the last day. And my desire is that my body may bee interred in the Middle Chancell in the parish Church of Saint John Baptist aforesaid. And as concerning my temperall estate which the Lord of his mercy hath been pleased to make me Steward of in this transitory life I give and bequeath as followeth that is to say Imprimis I give and bequeath vnto my vncle William Tomlin of the parish of St John Baptist aforesaid three pounds a yeare quarterly to be paid for and dureing the terme of his naturall life by my executors hereafter nominated Item I give and bequeath vnto the poore of the parish of Saint John Baptist aforesaid the summe of twelve pounds of lawfull mony of England to be paid vnto the Churchwardens and Overseers of the said parish to be kept in stocke for the vse of the poore aforesaid vpon the fest of St John Baptist next and immediatly after the decease of my said Vncle William Tomlyn. Item I give and bequeath more vnto the said poore of the parish of Saint John Baptist the summe of thirty shillings of lawfull mony of England to be distributed vnto them by my executors within six monthes next after my decease Item I give and bequeath vnto the poore of the parish of St Peters' in the said Isle of Thanett the summe of six poundes of lawfull mony of England to be paid to the Church Wardens and Overseers of the said parish for Stocke for the use of the said poore within six monthes next after my decease Item I give and bequeath vnto the poore of the parish of St Lawrence in the said Isle the summe of three poundes of like lawfull mony of lawfull mony of England to be paid vnto the Churchwardens and Overseers of the said parish for the use of the said poore within six monthes next after my decease Item I give and bequeath vnto my oldest sonne Stephen Tomlin the summe of twenty pounds of lawfull money of England to be paid vnto him by my executor within two years next after my decease, Item I give and bequeath vnto Henry Tomlin and Ann Tomlin children of the said Stephen the summe of five poundes of lawfull mony of England to bee paid vnto them when they shall accomplish and attaine to there severall ages of one and twenty years And if it shall happen either of them to dye before they shall accomplish vnto the said age of one and twenty yeares then the survivor to be the others heire Item I give and bequeath vnto John Tomlin my sonne one hundred poundes of like lawfull mony of England to be paid vnto him within one year next after my decease by my Executors hereafter nominated. Item I give and bequeath vnto Peter Tomlin my sonne the summe of one hundred poundes of like lawfull mony of England to be paid vnto him within three yeares next after my decease by my executors Item I give and bequeath more vnto my said sonne Peter Tomlin the eight part of a hoye with the appurtenances called Seaflower of Margate whereof James Coppin is now Master vnto God ymediately after my decease with all proffitts that shalbe then due vnto me from the said vessell. Item I give and bequeath vnto my sonne Francis Tomlin one hundred and fifty pounds of like lawfull mony of England to be paid vnto him when he shall accomplish vnto the full age of foure and twenty yeares by my executors Item I give and bequeth vnto my sonne Walter Tomlin the sum of one hundred and fifty pounes of like lawfull mony of England to be paid vnto him when he shall attaine unto his full age of fower and twenty yeares by my executors and if it shall happen any of my said sonnes to dye and depart this life before they shall attaine vnto their severall ages and dayes of payment above specified vixt John Peter Francis and Walter That then my will and meaning is that the porcon of him or them soe dyeing shalbe equally divided amongst the survivors of him or them. Item I give and bequeath vnto my daughter Ann Tomlin now wife of Abraham Terry the summe of five poundes of like lawfull mony of England to be paid vnto her within one yeare next after my decease Item I give and bequeath vnto my said daughter Ann her fowre children vizt Ann Mary Elizabeth and Alice the summe of five poundes a peice of like lawfull mony of England to be paid vnto either of them when they shall attaine vnto their several ages of one and twenty yeares And if it happen either of them to dye and depart this life before they shall attaine vnto their said severall ages as aforesaid then my will and meaneing is that the porcon of her or them soe dyeing shalbe equally divided amongst the Survivors Item I give and bequeath vnto Mary Tomlin my daughter now wife of Henry Arnett the summe of five poundes of like lawfull mony of England to be paid by my executors within one yeare next after my decease Item I give and bequeath vnto her two children vizt Edward and Henry the summe of five poundes a peice to be paid vnto them when they shall attaine vnto their severall ages of one and twenty yeares by my executors and if it shalll happen either of them to dye before they shall accomplish the said age of one and twenty yeares, then my will and meaneing is that the Survivor shalbe the others heire Item I give and bequeath vnto my three youngest daughters vizt Susanna Martha and Hanna the summe of two hundred and Fifty poundes a peice of like lawfull mony of England to be paid vnto them when they shall accomplish vnto their severall ages of twenty yeares by my executors And if it shall happen any of them to dye and depart this life before they shall attaine vnto their said severall ages of twenty yeares Then my will and meaneing in that the porcon or her or them soe dyeing shalbe equally divided amongst the Survivors of Survivor. And as touching and concerning all my Lands and tenements which I have in the said Isle of Thanett or else where I give and bequeath in manner following Imprimis I give and bequeath vnto John Tomlin my sonne my Tenement Mault howse barnes and appurtenances with eight acres of arrable Land more of lesse scituate lyeing and being at Margate in the parish of St John Baptist aforesaid and now in the occupation of me the said John Tomlin and John Hodges to him and his heires forever. Item I give and bequeath vnto my saide sonne John Tomlin sixteen poundes a yeare out of my part of my Farme called Updowne in the parish of St John Baptist aforesaid and nowin the tenure and occupation of John Francklin for which said Farme he payeth vnto me Forty poundes per Annum for my part to him and his heires for ever all which said Messuage Malthouse and Lands and sixteen pounds a yearee he shall enter vpon and receive within three monthes next after my decease Hee yeilding and paying vnto Mary Tomlin his mother out of his before mentioned premisses the sume of six poundes a year halfe yearly to be paid for and during the terme of her natural life Item I give and bequeath vnto my sonne Peter Tomlin all my part of the said Farme at Updowne rented at Forty pounes a yeare as abovesaid except sixteen poundes a year before given to John Tomlin as is above specified to him and his heires for ever within six monthes next after my deceases Item I further give and bequeath vnto my said sonne Peter Tomlin all that my Messuage or Tenement with the appurtenances and seaven acres of of arrable Land more or less and scituate in the parish of St Peter in the said Isle of Thanett and now in the tenure and occupation of Richard Joye to him and his heires forever within three monthes next and immediately after the decease of Mary Tomlyn his mother. Item I give and bequeath vnto my three youngest sonnes vizt Geffery Francis and Walter and to their heires for ever All that my Messuage or tenement barnes ____ and appurtenances with threescore and fower acres of Land more or less scituate lyeing and beinge at a place called West Northdowne in the parish of St John Baptist aforesaid and now in the tenure and occupation of me the said John Tomlin John Laming and John Crampe, equally devided between them when they shall attaine to their severall ages of one and twenty yeares Item I further give and bequeath vnto my said three sonnes vizt Jeffery Francis and Walter and to their heires for ever, equally devided betweene them Nyneteene acres of arable Land, lately purchased of the heores of Thomas Fleete lyeing and being neere Sanston(?) Grange in the parish of St John Baptiste aforesaid and now in the tenure and occupation of John Francklin when they shall attaine vnto their severall ages, of one and twenty yeares, as aforesaid. Item I further give and bequeath vnto my said three sonnes Jeffery, Francis and Walter, and to their heires for ever seaven acres of arrable Land more or less conteyneing fower peeces lyeing and being at two places one called Bacon Dane one the other neere St Peters Mill within the serveral parishes of St Johns and St Peters aforesaid, and now in the occupation of me the said John Tomlin, to them and their heires for ever equally to be devided when they shall attaine vnto their said several ages of one and twenty yeares. And wereas I have formerly made over on deede unto my sonne Stephen Tomlin, and to his heires for ever one messuage or Tenement with thappurtenances, and certaine Lands scituate lyeing and being in the parish of St Lawrence afoesaid and now in the occupation of William Ayrde And certaine other Lande to my said sonne Stephen lyeing and being in the parish of St Johns aforesaid, in the occupation of David Gredid(?) And also another parcell of Land formerly by me made over vnto Ann Tomlyn, now wife of Abraham Terry, and to her heires for ever lyeing at a place called Hayne in the parish of St Lawrence aforessiad, in the occupation of Roger Philpott, Reserveing the yearley rents and proffits thereof vnto me the said John Tomlin, and Mary my wife for and during the terme of our naturall lives. Now my will and meaneing is that the foresaid several rents and proffits thereof soe reserved shalbe and continue vnto Mary my wife and to noe other use for and dureing her naturall life, as is specified in their said deedes. All the residue of my goods cattells chattells Binne(?) bonde credits debts and ready mony whatsoever and wheresoever not before discharged I give and bequeath vnto my loveing wife Mary Tomlyn and to my sonne Jeffery Tomlyn equally to be devided between them whom I make nominate and appoint my full and sole executors of this my last will and testament Renounceing and disannulling all former wills by me heretofore made. And I would request my brother Capaine Jefferye Sandwell my sonne Stephen Tomlyn and Abraham Terry and Henry Harnett my sonnes in law to be Overseers of this my last will and testament requesting them to be aydeing and assisting to my said executors giveing them hereby full power and authority to end and determine all controversie if any shall or may happen to be between them And for their love and paines taken therein I give and bequeath vnto either of them twenty Nobles a peice to be paid vnto them within six monthes next after my decease by my executors. In wittnesse whereof I have herevnto sett my hand and seale to the last sheete of paper being fower in number the day and yeare first above written. A codicil annexed to the last will and testament of John Tomlyn of the parish of St John Baptist in the Isle of Thanett and county of Kent, yeoman this 25th day of June Dni 1649 as followeth
Imprimus whereas I have given in my said Last will and testament vnto my two sons John Tomlin and peter Tomlin the summe of one hundred pounds a peice within certaine time therein specified Now my will and meaneing is that my said executors shally pay vnto the said John Tomlin and Peter Tomlin my sonnes but the somme of three score poundes a peice aforesaid mony of England at the time and dayes therein limitted and specified for the payment of the said one hundred poundes a peice and where as I have in my asid will given and bequeathe vnto my yougest sonnes Francis and Walter several Legacies therein expressed And vnto my three youngest daughters vizt Susanne Martha and Hanna also severall Legacies herein expressed upon severall dayes of payment therein mentioned And haveing not made any provisoe therin for the better maintenance and education of them Now my will and meaning is that my executors shall maintaine educate and bring up my said children above specified to schoole and to such a competent measure of learneing as shalbe fitt and convenient for their severall proffessions But in case my Executors shall refuse or neglect to maintaine educate and bring up my said Children as above specified or if my loveing wife Mary happen to change her life and marry Then my will and meaneing is that the overseers of my will vizt my brother Captaine Geffery Sandwell my sonne Stephen Tomlin and Abraham Terry and Henry Varnett my sonnes in law shall have the education and tuition of my said children vntill they attaine and accomplish vnto their severall ages in the said will mentioned and expressed my said executors paying vnto them for my said two sonnes Franceis and Walter the summe of twenty poundes a peece yearly for their maintenance and education And also paying vnto them for the maintenance and education of my three daughters vizt Susanna Martha and Hanna the summ of sixteene poundes a year a peece All which yeerely payments both for my two sonnes and three daughters shalbe halfe yearly paid by my executors to my overseers above named And where as there is now a suite depending between the widow of Thomas Fleete of Cosmoo Le Bleane_ and me the said John Tomlyn and Henry Franklin concerning certaine Lande belonging to Updowne in the parish of St John Baptist aforesaid which said Farme and Lands I have given and bequeathed vnto my sonne Peter Tomlyn being forty poundes a yeare for my part exepting sixteene poundes a yeare given unto my sonne John Tomlin out of the same. Now my will and meaneing is that what losse and damage shall or may accrew by reasen of the said suite unto my said sonne Peter either by charge of suite composition or otherwise shalbe equally born and defraied by my said sonn Peter and my exeutors In witness whereof I have herunto sett my hand and seale the day and yeare above written John Tomlin sealed signed published and declared as a codicell annexed to my last will and testament in the presence of Jeff: Sandwell, Thos Smith Richard Genney.

1651 "June 21th buried John Tomlyn yeoman" at St John the Baptist, Margate, Kent. [5]

1651 The will of John Tomlyn was proved on September 24 in the Prerogative Court of Canterbury at London with administration granted to Mary Tomlyn the Relict and Jeffery Tomlin the son of the deceased, executors named in the will. [6]
