Regulation and Liability of Social Networking Sites

Katie Krajeck

October 25, 2006

Overview: Given the rapid growth of social networking sites, their popularity among children and teenagers, and the potential profits at stake, I would like to focus our discussion on possible legal regulation and prospective liability of MySpace, Facebook, Xanga, et. al. So far, no case law exists regarding this issue. At present, however, not a day goes by without the media reporting upon the dangers associated with social-networking sites and the often illegal ramifications of interaction within these electronic forums. Please look at the following articles and documents to get a sense of the current state of the law. Be ready to discuss what (if any) statutory and/or legal changes are needed to tackle issues arising out of the use of social networking sites.
